Re: Mug templates

Post by Photomouse »

Hi Angloman,

I've just received an email from from them saying they can be resold. It all sounds legit to me. He said if I have any problems just get in touch with them. I've purchased them myself, but thanks for the offer. I cant wait to get started now.

Do you have any of the keep calm ones? Thats my next thing to find!

regards
Angie

Please be very wary of using any of them that have Disney or football logos... if they really are available for resale then he will happily tell you if he has the licencing rights to reuse and sell on both those (which I highly doubt after looking into the Disney side of things myself). If he doesn't not only is he in breach of copyright/licencing laws - but if you use them, so are you.

I know a few of us keep going on about copyright etc.. but if you are serious about making yourself a legitimate business, all these things will matter.. and it's not a case of I am small I won't ever get caught.. it's more a case of how long before you do!!

thanks for the feedback. Here is the email that he sent. What do you think?

many thanks for your purchase. All the templates in your purchase have reseller rights as prints onto mugs. We have sold many mug templates and never had any issue with copyright comebacks. We carefully design our mug templates taking the greatest care not to infringe any copyright laws and we have had no issues to date. As an example the mug templates that have cartoon characters in them have been designed so that the emphasis is on the frame and colouring of the mug template and the cartoon character is not a main feature of the design.
If you receive any licence issue’s please do forward the licence allegation to us and we will respond accordingly.

I Hope this helps you out and please keep a copy of this email for future reference.

Also some sites offer a royalty free image which is good if you pay the small fee to be able to use the logo/picture/illustration

@photomouse- All Disney type stuff is copyright and football stuff, especially Everton ,I had to get a special publish raster file to be able to print on to an ipad. The disk is great for ideas and some templates are really good ,but take care using some of them, as they do contain images that are not royalty free like Disney etc.

Nice email from the chap, I thought he was very helpful. He runs a full business doing what he does,I have bought it to help me get ideas as well as like me you are just starting up

I hate to say it but that guy will end up getting himself and others in deep water.. just because it's not the focal point of an image doesn't mean it's right to use it.

Also, just because something is on google.. doesn't make that free to use either..

My images show up on google in some places.. and god forbid I ever see them used without a commercial licence..

PLEASE research properly and stop lining the pockets of those that breach these rules..

NO - they are on Google so you can look at them, and that's all, unless the website they come from when you click through expressly says otherwise, just because they are on Google, doesn't mean it is public domain, copy right free, and free to use. A lot of our designs show up on Google images, we didn't put them there, and weren't asked if we wanted them there, and it doesn't mean you won't be getting a call from our lawyers if you use them though, and yes we already have legal representation set up for this type of dispute, and we are certainly not the only designers to.
Just because you can take an image from a google search or a seller selling jpgs or Disney characters, and then reprint it onto a mug, doesn't mean you are legally entitled to. We spend a lot of time/money on our own artwork and designs and producing them onto products to sell. What you are doing by using someone else's design without the original designer's/artist's/copyright owner's permission/license agreement is theft. If you want to be in business, be taken seriously, and be able to last, then do things properly, and this includes either making your own designs, licensing them properly, or hiring a designer/artist to design for you.

Most criminals are if you give them money, and to be honest if he is saying that the Disney stuff is legal to use that is what he is.
