Re: bms
hi all , i ordered some place mats from BMS but got the wrong ones i spoke to the woman she said return the items for a refund , i ordered the other more expensive place mats sent parcel back with a note in asking to refund to the payment type used, email today saying they have refunded for use as loyalty points , which is not what i asked for , not overly impressed.
if i have asked to return a item for a refund , a refund should be given ?

call Martin. I am sure he will refund your money directly to the bank.

Am I reading this correctly?
You ordered the wrong place mats?
They have given you a credit so you can use it on your next order?
If the answer to those questions is "Yes" then come on, it was your error not theirs.
Or am I just being a grumpy Janners?

Legally, the only difference between the customer making a mistake and the vendor, is who pays for the postage.JMugs;76669 wrote:Am I reading this correctly?

If the customer changes their mind, they are still entitled to a refund which also must include the cost of sending the item in the first place

Page 10 2nd Paragraph
A lot of companies either don't know of this requirement or try and ignore it hoping you don't know your rights. And just because they might say it in their T&Cs it has no basis in law and cannot be enforced.
Also, the customer is only liable for the cost or returning the item if the vendor has specifically made that clear beforehand. If a vendor does not tell you you need to pay to return the item beforehand, they cannot then ask you to pay for the return at a later date. as the law does not allow this.
If the vendor has made a mistake then they are responsible for refunding all postage costs incurred by the customer regardless.
Too many companies trade without knowing their legal obligations, or are willfully ignoring them. Usually if they are stupid enough to have put their intended breach of the law into writing, a response that you will be passing on said communication to local trading standards, is enough to get things moving in your direction.
Cheers
