Hi A charge back can be instigated by your bank on your request basically you tell your bank your complaint and you want to do a charge back they can then claim the money back from who it was paid too (it also costs them £35) i know ive had one put against me by a bloody american who paid me twice for 1 item instead of just asking for a refund they did a charge back unfortunatly i didnt realise it would cost me £35 so i just agreed it was only bloody £2.50 they claimed back grrrrrrrr
who did you pay was it amazon or directly to the seller? if you pay amazon well the bank would do a charge back against them it may be worth contacting amazon again stating the 7 day distant selling legislation and tell them unless they sort it imediatly you will do the charge back against them

What that seller is telling you is illegal. You have every right to return the item at your cost. Seven days is only a guideline, you can actually take longer to return the item.

Inform the seller he is breaking the law, complain to Amazon, open an A_Z claim and leave some negative feedback on his selling account for good measure.

many thanks for all your advice .Tomorrow I shall do GoonerGary recommended will let you know how I get on. To top it all the item is 40 pounds dearer than everywhere else, buy in haste repent in leisure they say. Something I'll remember next time I click, read the small print

As long a they are a business and you informed them within 7 working days, then they are breaking the law, if you get no joy then i would be going to trading standards as well.

He's a business because he is selling goods for profit whether he files a tax return or not. I read somewhere that you actually have longer than 7 working days, but most guidelines state the 7 days. I don't know why this seller is risking an A-Z claim as Amazon side with the buyer, but what do we care about his account?

You have 7 working days to notify the seller, but i think up to 3 mths to send it back or make available for collection depending on sellers T&C's

Also if you buy or make items with the intention to sell that makes you a business, not if you sell for profit, as some business make losses, but they are still a business.

I took the advice and read the links and then I sent a email quoting different things, said about the charge back and he now agreed to to take it back.
I have copy and pasted his reply.
I do not delay time. I am disappointed as the size is written on the title of our listing on Amazon. In my e-mails I told you that if we accept used goods which are not faulty we cannot return them back to our supplier or resold them. Many high street shops have 90% of their goods non refundable unless they are faulty. However I can refund your money if the item is in the original packaging.
Please return the item back to me in the original package:
I never complained of size, I have not used it, just took it out for a look before I realized it was not suitable for what I want.
Still it going back but I need to do this so I have proof of postage and him receiving it, so I can get money back, which is the best way to do this

Sounds like english isnt their first language, not your problem if they cant resell, the bit about shops doesnt apply to distance selling regulations.

Youll need a courier with online tracking.
