If a business has a website they have to state certain information on the website including company name and the geographical address of the company (both for limited companies and sole traders) - so there is no point in opting out on whois. This is the law under the E-commerce Regulations 2002.

Plus, customers want to know who they are buying from - an address helps to reassure them.

Also if you sell online, you have to give customers your address when they make a purchase under the Distance Selling Regulations.

PS - Nominet do check for .co.uk, I accidentally opted out on a UK domain name and they phoned me up to query it.

How would this work if I was a webmaster that made a living from selling websites?

I would be buying the domain names and creating the websites for others who would have to state their details on the 'website' of who they are/address etc.

But, the domain was registered by me and would be in my name so I would opt out of the 'who is' option as I wouldn't want my details available for those sites currently being built and not live yet.

Just thinking out loud here - we're talking about 1 person/company being the registered owners of the domain and website where as my suggestion is a third party that registered the domain and creates a website for a company that is a limited company???

I have been building websites since 1994 and register a client as the registrant and me as the Administrative contact. This procedure is good practice and is in accordance with Nominet's recommendations.

If you build a website and then sell it you simply transfer the domain name to the new owner - Nominet charge for this.

At a guess I wonder how many do have the whois filled out for then by either the company that they purchased the domain off, or the person building the website. I know 3ix automaticlly do this when you purchase, and every 3 or 4 months email out to check all details are still correct. But like i said earlier in thread if your trading legit why hide who and where you are.

Are these with hidden whois etc the ones HMRC are tracking down for tax avoidence?.................

It must be legal as they would not give you the option, If I was running a business from home I would not want my home address posted, because if you have pi..ed someone off they could use this information for harassment, and maybe target you in many unpleasant ways. I have a shop my address is visible, but give me home address NO. The tax man has other ways of finding you, mainly by people using WHOIS service and telling them.(lol) (that was a joke )

Well if you are a limited company and have your registered address as your home address then you have no legal choice but to put this on your website and whois. I suppose you could change your registered address to one of these remote office addresses but to be honest if someone wants to track you down and hassle you I am sure they could anyway.

Except that any personalised item is exempt from the distant selling regulations.

Why is it that when I typed dyesubforum.co.uk into whois it said :
[h=1]dyesubforum.co.uk is available *[/h]So does that mean I could be the new forum master.:wink:
