I can see some grief coming their way - I had a quick look at a few of their mugs, most of those were infringing someone's copyright/trademark, sales into the thousands just on the few I looked at.

With the sales numbers shown by eBay, trading standards would have little other research to do to file a case...

Like I said the retail value of all the mugs they stole from me was one million 3 thousand quid. I'd have to take them to the High Court for the abuse of my trademark.

Wow! I missed that point!

Surely you can't afford not to pursue that?

It's just unbelievable that anyone would dare to expose themselves to such a potentially huge settlement...

They are slimey **** they deny everything, bare faced lairs in my past dealings. Better to pass it on to someone with more clout. Ever watch Won't pay, we'll take it away?

I've seen the programme in the listings but never watched it - maybe I should :-).

I'm sure it must be worth your while to retain the services of someone who can deal with this - there's not only your loss of income, but loss of goodwill and other potential sales due to poor quality passing off...

When you say over a million at retail they have stolen from you is that what they have sold on your designs or just listed? That makes a sizeable difference on what you can claim against them I believe.

Amazon should take action if you can prove it. Just report 1 design every few days so it is continuous infringements. Should make them stay clear of you ongoing.

Strange collection of items they have as most are clearly just bought in stock ready for pick and pack.

Listed. I'm not so sure. 999 items per mug design in an Amazon shopping cart is only one click away from purchase which they would have sold to anyone. They manufacture mugs and had the ability and willingness to do so. I would sue for the loss of a wholesale order and trademark/ copyright infringement.

At the risk of getting shot down in flames here ...... What's the difference between these people stealing your designs and Coralgraph stealing them (as mentioned in a previous, now deleted, thread?).

Just asking. Tell me if I've got hold of the wrong end of the stick here! :wink:

Coralgraph changed designs to their own version so slightly different. One of the designs mentioned on the thread where it was basically the same as another seller then had someone else say they also had the same design. Who copied who with the idea though and who can prove it? Loads of people have very similar stuff but if someone comes up with a new design and applies for protection on it then that is different.....which is what I assume GoonerGary has done. If someone puts up exactly the same design with no changes they haven't really got a leg to stand on. For many designs you will find endless people doing roughly the same thing if it starts selling. Most people can't be bothered going through the extra cost and work to protect it. If someone does like GoonerGary then they have every right to chase people down.
