He was also saying I could not have 'Keep Calm - Carry on' or any of the variations on the theme. But I pointed out to him that the idiot who has gained a tradmark for the 'Keep Calm - Carry on' white on a red background had only got it in the EU and that he was turned down for the UK, and that there is a case on at present to overturn his trademark. He had to back down on that one!

I think it has more to do with the fact that they have to REFUND your listing fee if you take down your ad. Tell me any business that likes giving customers their money back and cancelling transactions, especially on the volume of trade a mainstream auction site does.

Incidentally I have had my own designs lifted before now, but copyright protection, or rather copyright enforcement is for those that can afford the huge legal fees to pursue it.

They may well have to refund the listing fee i agree the point is they can remove an item at will ok they may need to refund listing fees but thats not really the point that was being made. As for your own designs i believe there is a registration service with ebay that if you register your designs with them then if you do find someone copying your designs ebay will remove them if you complain not sure what the service is called though

As far as I know, eBay will only step in on the copyright side if someone has copied your entire listing, as someone did with a secondhand machine I sold a few weeks ago. From personal experiences with them, they will accept copyright on the text within your item description, but not on the actual product images.

I did approach eBay on the whole broader issue of copyright protection about three years ago, but all I got was basically a 'couldn't care less' attitude. Ebay just don't want to know and why should they when they are making such huge profits from being a facilitator.

I finally had some success with ebay vero when it came from my solicitor. Every time I do a search on ebay, I will find a new person infringing my copyright. I've decided to actually pursue the infringers until the end. Scumbags think they can steal from you, sell your own design in competition with you and get away with it, not anymore. The guy is facing a legal bill of thousands plus damages of over £10,000 from products he was selling for £2.99.

WOW that's quite brave of you. I hope your solicitor has also told you that if the case goes against you, then YOU will be the one potentially facing thousands in legal costs, which is why legal action is usually the preserve of wealthy. Win or lose, the legal folks will always make their money out of it though.

If you want to protect your designs, you should look up/join ACID (Anti Copying in Design) Designers we know have been ripped off by big high street chains, and as they were in ACID were able to stand up to the high street and win.

Open and shut case, caught red handed and he hasn't a leg to stand on. He knows he done wrong, I expect him to settle before it goes to court.

Hello, what do you think about the custom mug business for now? Honestly I want to earn extra money by channeling my hobby of designing into money. I have sold several mugs with screen printing in the local market but the profits are not that big because of the pandemic effect.
