This bit summarises the situation quite well, I think, and must also apply to your "I Cornwall" type designs:
... the sign was viewed as being likely to be recognised by consumers as a statement being made by the wearer rather than an indicator of origin. As a result in terms of these goods the mark was viewed to be devoid of the necessary distinctive character needed to function as a trade mark.

I just thought i'd do a little update, my dad had a word with Tradings standards from another county re the correct proceedure to follow after someone has made a complaint. As you said JSR it does seem that someone was waving a big stick as the TSO would not be involved in a situation like this and it would be a civil matter at this stage. Unless I was selling rotten meat or dealing with large amounts of cash.

Dad is actually going to send him a legnthy email tomorrow so it will be interesting what he says.

Re copyright etc it still goes on and on.... Business Link have also kindly sent me some advice sheets regarding copyright specifically for the t shirt printing industry.

Have not read it yet but if anyone would like to have a look let me know and I will email the brochure. Although I won't be able to do so until Friday.
