As far back as I can remember.... during school holidays to visit my family who lived just outside Barry, we all used to call it Barrybados. I now live a stones throw away (about 3 miles) from Barry and still call it Barrybados....and Im now knocking on 50 ! Even on the ITV news it is quite often referred to as Barrybados! ..... and if Im not mistaken.... I have seen that design on numerous occasions (or something very smilar).

As far as I know, you can't trademark a phrase which has become customary in your line of trade. So if Barrybados has been in popular use, could the trademark be challenged? Only worth it, if you intend putting those T shirts into every shop around town.

This morning I received an email from a chap requesting that I remove the shirt from my website as last year he tademarked the term Barrybados. I checked and indeed he's correct, re registered the trademark in 2013.
Now I've not sold one single Barrybados shirt so this is no biggie for me and I will remove the shirt from our website however, the question I would like answered is: Do I have to remove the item, it was designed before he registered the trademark?

I checked the IP site and this trademark has a checkered history but has a fresh 2023 trademark valid for 10 years.
So what If, for arguements sake, I print the same shirt but as BARRY-BADOS is that still an infringement of the original trademark please?

Probably be 'passing off', which is very hard to prove by the trademark owner but could still cost you time and money to defend, especially if you lose.

Immensly interesting, and odd that the barrybados copyright holder have no problems potentially breaching copyright in what they sell.

You can't use anything that remotely resembles the trademark - I asked
