I know there is someone on here with a virtually identical name to one of my websites (sounds exactly the same) and I also think the branding is heading in exactly the same direction as well. If and when the branding becomes to similar then I might be sending one of those polite emails as well. Nothing worse than someone jumping on the back of all your own hardwork.

Might be an idea if they are members who are doing this to name & shame them & also ban them from the forum.

You would probably be looking more at a "passing off" action in that case ... A little legwork will reveal much. I have one particular brand that has been 'assaulted' a number of time on that score.

As Martin suggested; a dog-eat-dog world sadly... Thing is, there is really no need to lie down with dogs. And those who insist in doing so may expect to get up with fleas.

I got a response from the party concerned and changes have been made to their site with an apology.
It turns out that a friend was putting the site together and was unaware of this problem. Benefit of the doubt I think.

Thanks to everyone who contributed to this thread, with a special mention to Matt. It may make others think twice in the future.

Wouldn't we have to have some sort of trial before banning someone for being accused of doing something wrong?

Glad you got it sorted it can be a right PITA when people do this. The only good thing when they copy and paste content is that the fact google penalises them so it will effect their rankings. As your site is likely to have been indexed before theirs they will get the hit.

Having done a very similar thing myself of copying and pasting loads of content from my 1st to my 2nd the 2nd site suffered whilst my other site was still a page 1 hit. I couldn't work out why my other site wasn't even showing up in google as it was still getting loads of hits and was virtually identical to the first site, to which google informed me of what they use to penalise sites, was annoying as it was all my content but was also good to know they actually took action upon such things.

As for watermarking images legally you don't have to, you still own the copyright if its your image regardless of a watermark or not. Whilst they will deter some people from stealing the image they can also be off putting to customers if the cover the image with a watermark. Obviously a little watermark in the bottom corner is easily cropped out. Copyscape.com is a good website for checking, you can use it for free or you can pay for the better search results.

you could also implement a little java code to stop Right-Clicking (to save images) on your site. a little message will pop up saying that the image is copyright to you etc.

the right click is easy to get around by simply hitting the "prt scr" button on your keyboard to get a screen-cap of your page, but thats time consuming and only the hardiest of people will do that, but for the sake of it, you could just insert that java.

It might help, but Windows 7 comes with a little 'snipping tool' which takes part of screens as does a simple piece of software called mwsnap. The message though will re-inforce the notion that such images aren't free to download and use.
