Trust me; copyright law is one of the specialisms I lecture in....

    "Crown Copyright

Crown Copyright is defined as works made by Her Majesty or by an officer or servant of the Crown in the course of his duties (Section 163, Copyright, Designs and Patents Act 1988).

    http://www.legislation.gov.uk/ukpga/1988/48/section/163

All literary, dramatic, musical and artistic works (including computer software) produced by officers or servants of the Crown (including the Armed Forces) in the course of their duties are Crown Copyright.

The most obvious material covered includes reports, photographs and films, regimental badges and other insignia. MOD and Armed Forces personnel can copy MOD Crown Copyright material without limitation, provided that it is in the course of their duties and for official purposes.

Crown Copyright lasts for 125 years from the end of the year in which a work was created or 50 years from the end of the year in which it was published (whichever is the shorter). "

...NOTE the legitimate companies supplying this sort of material are all quite clear about their licencing position!

Sorry - but the fact is the idiot who placed that badge on Wikipedia had no right to reproduce it himself, no right to post it on Wikipedia - And certainly isn't in a position to grant anyone any kind of rights over it!

My apologies Laura, I did slightly misunderstand...

However, people do need to be clear on this... In reality a one-off for an old soldier? I wouldn't expect a problem. The MOD are surprisingly kind to model makers and military enthusiasts and old servicemen though there is a 'party line'...

    - The danger lies in things like that Wikipedia entry! And people potentially 'harvesting' such material to make goods 'on spec' based on that ridiculous licencing statement! And it's surprising how often you come across that sort of scenario.

    Firstly I am a girl! :-)
2nd - they are all covered by copyright - we have one license for the Army, one for the RAF and One for the Royal Navy which is reviewed every 2 years and we also pay a percentage each time you use a crest. Not worth taking the risk if you are selling publically - I know one chap has been recently taken to task on this and is now out of business!

    Good Luck!
